Heyko — Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you and Beijing Haiban Technology Co., Ltd. ("Heyko," "we," "us," or "our") and govern your access to and use of the Heyko mobile application and related services (collectively, the "Service"). Heyko is a social networking application that helps people meet and chat with new people. Please read these Terms carefully. By creating an account, downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

Please note: Section 17 contains an arbitration agreement and a class action waiver that affect how disputes between you and us are resolved. Section 14 and Section 15 limit our liability to you.

01Acceptance and Eligibility

Acceptance and Eligibility

By using the Service, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal capacity to enter into a binding contract; (c) you are not barred from using the Service under the laws of any applicable jurisdiction; and (d) you have not previously been removed from or banned from the Service.

The Service is intended only for adults. If you are under 18, you may not access or use the Service under any circumstances.

02Your Account

Your Account

You may register using Google Sign-In or other supported methods. You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials.
You may not share, sell, transfer, or license your account to any third party.
You must notify us promptly at pikaqiu_88@163.com if you suspect any unauthorized use of your account.
You may maintain only one account unless we expressly permit otherwise.

03License to Use the Service

License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the Service for your own personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Service, except where such restriction is prohibited by applicable law.

Community Rules and Prohibited Conduct

We have zero tolerance for objectionable content and abusive behavior. When using the Service, you agree that you will not:

Harass, bully, threaten, stalk, intimidate, or defame any person;
Post, send, or share content that is hateful, discriminatory, sexually exploitative, obscene, violent, or otherwise objectionable;
Produce, share, or solicit child sexual abuse material or any sexual content involving minors; engage with or attempt to contact minors;
Engage in fraud, scams, phishing, "catfishing," romance scams, or any deceptive or misleading conduct, including impersonating any person or entity;
Solicit money, financial information, gifts, or personal contact details from other users for fraudulent or exploitative purposes;
Promote or engage in prostitution, human trafficking, or any illegal activity;
Post spam, advertisements, chain messages, or unsolicited promotional content;
Upload or transmit viruses, malware, or any harmful code, or attempt to gain unauthorized access to the Service or other users' accounts;
Use bots, scrapers, or automated means to access, collect data from, or interact with the Service;
Collect, store, or share other users' personal information without their consent;
Infringe the intellectual property or other rights of any third party;
Violate any applicable law or regulation.

Violation of these rules may result in content removal, suspension, or permanent termination of your account, and may be reported to law enforcement where appropriate.

05User Content

User Content

"User Content" means any content you create, upload, post, send, or share through the Service, including profile information, photos, messages, audio, and video.

Ownership. You retain ownership of your User Content. We do not claim ownership of it.
License to us. You grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, reproduce, adapt, display, and distribute your User Content solely for the purpose of operating, providing, improving, and promoting the Service, and as otherwise permitted under our Privacy Policy. This license ends when your User Content is deleted, except for content that has been shared with others who have not deleted it, and except as required for legal, safety, or backup purposes.
Your responsibility. You are solely responsible for your User Content and represent that you have all necessary rights to share it and that it does not violate these Terms or any law.

06Content Moderation, Reporting, and Blocking

Content Moderation, Reporting, and Blocking

We may, but are not obligated to, monitor, review, screen, or moderate User Content and conduct, including through automated and human review, for safety, legal compliance, and enforcement of these Terms. We may remove or restrict any content or account at our discretion, with or without notice.

The Service provides in-app tools that allow you to report and block other users. We encourage you to use these tools if you encounter abusive, inappropriate, or suspicious behavior. We aim to review reports of objectionable content and act on them, including by removing content and removing offending users.

07Safety and Interactions With Other Users

Safety and Interactions With Other Users

You are solely responsible for your interactions with other users, both online and offline. We do not conduct criminal background checks or identity verification on users and make no representations about the conduct, identity, or suitability of any user.

Use caution and good judgment when communicating with or meeting people you do not know.
Never share sensitive personal, financial, or account information with other users.
If you choose to meet someone in person, meet in a public place and tell someone you trust.
Report suspicious or harmful behavior to us and, where appropriate, to local authorities.

To the fullest extent permitted by law, we are not responsible for the conduct of any user or for any harm resulting from your interactions with other users.

08Purchases, Subscriptions, and Virtual Items

Purchases, Subscriptions, and Virtual Items

Billing. The Service may offer paid features, subscriptions, and virtual items. All purchases are processed through Google Play Billing and are subject to Google Play's terms. We do not collect or store your payment card details.
Subscriptions and auto-renewal. Subscriptions automatically renew for the applicable period unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Google Play account settings.
Virtual items. Any virtual currency or virtual items you obtain are licensed, not sold, to you, have no monetary value, are non-transferable, and cannot be exchanged for cash. They may expire or be forfeited if your account is terminated.
Refunds. Except where required by law, all purchases are final and non-refundable. Refund requests are handled in accordance with Google Play's refund policies.
Price changes. We may change prices and the features included in paid offerings. Changes will not apply retroactively to purchases already made.

09Intellectual Property

Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by us or our licensors and is protected by intellectual property laws. "Heyko" and our logos are our trademarks. Nothing in these Terms grants you any right to use them without our prior written consent.

10Third-Party Services

Third-Party Services

The Service relies on or integrates third-party services and SDKs, including Google Sign-In, Google Play Billing, Google Firebase, and Umeng. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services or content, and your dealings with them are solely between you and the third party.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share your information. By using the Service, you consent to those practices. Please review the Privacy Policy carefully.

12Term and Termination

Term and Termination

By you. You may stop using the Service at any time and may delete your account in the app by going to HOME → ME → Delete Account, or by contacting us at pikaqiu_88@163.com.
By us. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if we are required to do so by law, or to protect the safety of users or the integrity of the Service.
Effect of termination. Upon termination, your license to use the Service ends. Sections that by their nature should survive termination (including User Content licenses already granted, disclaimers, limitations of liability, indemnification, and dispute resolution) will continue to apply.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING THE CONDUCT OF ANY USER OR THE QUALITY, SAFETY, OR LEGALITY OF ANY USER CONTENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL LETSCHAT, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR INTERACTIONS WITH OTHER USERS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) USD 100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Heyko and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.

16Dispute Resolution; Arbitration; Class Action Waiver

Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully — it affects your legal rights.

Informal resolution. Before bringing a formal claim, you agree to first contact us at pikaqiu_88@163.com and attempt to resolve the dispute informally for at least 30 days.
Arbitration. Except where prohibited by applicable law, any dispute that is not resolved informally will be resolved by binding individual arbitration rather than in court, except that you or we may bring claims in small-claims court if eligible.
Class action waiver. To the extent permitted by law, you and we agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative action.
Your rights. Nothing in this section limits any non-waivable rights you may have under the consumer protection laws of your place of residence.

17Governing Law

Governing Law

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-laws principles, except that mandatory consumer protection laws of your country or state of residence may also apply to the extent required. Where any provision of these Terms conflicts with such mandatory laws, those laws will prevail to the minimum extent necessary.

18Changes to These Terms

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, where appropriate, provide additional notice (such as an in-app notification). Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.

19Miscellaneous

Miscellaneous

Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
Severability. If any provision is found unenforceable, the remaining provisions will remain in full effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Apple/Google app stores. Your use of the Service obtained through an app store is also subject to that store's terms.
